Terms of service

These terms apply between UNQ SOFTWARE and the store that installs LumiOffer. By accepting them in the app the store agrees to them.
The service
LumiOffer adds offers to the store (volume discounts, bundles, buy X get Y rewards and popups) through a Shopify theme app extension (an app embed and an optional app block). Discounts are applied at checkout by a Shopify Discount Function through automatic app discounts that LumiOffer creates and updates ("LumiOffer offers"); popups can hand out unique single-use Shopify discount codes. LumiOffer never edits theme code; turning off the app embed removes it from the storefront.
Merchant responsibilities
The merchant decides and is responsible for everything shown to shoppers: offers, discounts, prices, popup texts, the email consent text, messages and translations, and that they comply with the consumer, pricing, tax, marketing and privacy laws that apply to the store. The merchant keeps a cookie banner or other consent mechanism where the law requires one and is responsible for how it uses customers and marketing consent collected through popups. LumiOffer does not give legal, tax or financial advice.
Discounts and checkout
Discounts are applied by Shopify at checkout according to the merchant's offers and Shopify's discount combination rules. Popup codes are single-use and expire at the time the merchant chooses. The merchant should review offers and prices before publishing and after changing products, markets or currencies.
Measurement and recommendations
When measurement is on, a small share of shoppers who allowed analytics (the holdout group) sees no offers so that results can be compared. Analytics, extra revenue (lift) figures and margin calculations are statistical estimates, not guarantees of revenue or profit.
Safety and availability
An offer that fails in a shopper's browser hides itself so the store keeps working, and LumiOffer emails the merchant if an offer stops showing. We do not guarantee uninterrupted or error-free service, and we are not liable for sales lost because of theme changes, other apps, Shopify outages or the merchant's settings.
Plans and billing
Plans: Free, Growth ($19), Pro ($49) and Plus ($99) per month, billed by Shopify through Shopify App Pricing; nothing is charged unless the merchant approves it in Shopify. Paid plans start with a 14-day free trial, and annual billing gives two months free. On the Free plan a small LumiOffer mark appears with offers. The merchant can change or cancel a plan at any time; cancellation takes effect at the end of the current billing period.
Acceptable use
The store must not use LumiOffer to mislead shoppers, for example with fake scarcity, discounts it does not honour or hidden charges, to send marketing to shoppers who did not consent, or to break Shopify's terms.
Limitation of liability
To the extent the law allows, our total liability is limited to the fees the store paid for LumiOffer in the 12 months before the claim, and we are not liable for indirect or consequential losses.
Ending the service
The store can uninstall LumiOffer at any time. Data is then deleted as described in the privacy policy.
Changes
We may update these terms. We announce material changes in the app and ask merchants to accept them again.
